Cannabis Product Liability Insurance in California

When a consumer alleges injury or property damage from a cannabis product, the claim rarely stops at the last cash register. Manufacturers, distributors, and retailers can all be named. Cannabis product liability insurance is the coverage conversation for finished goods — separate from premises general liability in many programs. Why product liability is not “the same as GL”

Premises GL responds to slip-and-fall and many operations exposures on site. Product liability responds when the product itself is alleged to have caused harm — contamination, labeling, dosing disputes, and related theories that show up in this class. A certificate that lists GL but is silent on product is how a trading partner or landlord rejects the afternoon you planned to ship or open.

Claims can travel the supply chain. Even operators who “only” sell third-party brands should confirm whether product sits on their paper and what the lease or distribution exhibit requires.

Who typically needs a serious product conversation

  • Manufacturers and extractors (Type 6 / Type 7 and related)
  • Distributors moving branded or white-label goods
  • Retailers and delivery operators selling finished products
  • Microbusinesses combining manufacturing or retail with other activities

What underwriters ask

  • License types, entity name, and premises used for manufacturing, packaging, or retail
  • Product list (flower, edibles, vapes, topicals, beverages), labeling controls, and testing practices
  • Revenue mix, distribution footprint, and prior product or recall losses
  • Whether product is on the same form as GL or on separate paper, and which limits apply
  • Lease or trading-partner exhibits that already dictate limits and additional-insured wording

Product liability FAQ

Is product liability required by DCC for every license type?

Requirements vary by license class and by what landlords and trading partners demand. Distributor CGL minimums in 4 CCR §15308 are not a substitute for reading your own checklist and contracts. Confirm with DCC and your broker for your class.

If I only retail other brands, do I still need product coverage?

Often yes in practice. Claims can name multiple parties in the chain. Confirm what your policy and your lease actually require — not what a generic BOP brochure implies.

Does product liability include product withdrawal or recall expense?

Not automatically. Withdrawal/recall expense is often a separate discussion and sublimit. Ask the form, do not assume.

How does this relate to certificates?

Holders may want product liability limits shown on the COI. Wrong limits or missing product entries are common reject reasons. See certificate rejects.
